Minor’s DUI Penalties are too Harsh in Utah

The penalties for minors and some alcohol related charges recently changed. Most notably, Utah laws were changed to increase the penalties imposed on minors who have been drinking and driving. If a minor is pulled over and is found to have any measurable amount of alcohol in their system, they can be charged with a DUI. This means that if you are under the age of 21, you are pulled over, and you blow a .01, you may be charged with a DUI; a minor does not have to blow a .08 in order to be charged with a DUI. This has been the law for some time. However, recently the penalties associated with a minor’s DUI changed such that, if you (as a minor) have been charged with a DUI, you may lose your license for a period of 120 days or until you reach the age of 21, whichever is longer. This is a harsh penalty because minors charged with a first time offense, who may be under the .08 limit, still may lose their license for potentially several years.
