When one hears the word “rape” one may envision a man hiding behind the bushes waiting for a woman to run by while jogging and then grabbing her and using violence to sexually assault her.  “Date rape” is different.  The common scenario is that a man and woman consensually go out with each other and then they end up having sex.  In many cases violence is used, but in many other cases buyer’s remorse takes control.  This means that the couple has sex, but then the woman in hindsight wishes she had not done it and becomes convinced she was raped as a means of relinquishing the guilt.

Date rape is all about “he said she said” and without indisputable video, audio, or eye witness evidence there is no way to determine whether the sex was consensual.  Juries are placed in a difficult position in such cases because they are faced with the testimony of the alleged victim and maybe the testimony of the alleged perpetrator with the former claiming that she did not consent to sex and the latter claiming that the alleged victim did consent to sex. How can a jury make a finding of “beyond a reasonable doubt” when there are two stories and only one of them can be right? Statistically a jury in such situations only have a 50% chance of getting it right.  Nonetheless, juries are charged with determining guilt or innocence and they may not get it right, but that is the system.
