Juries are placed in a difficult position in such cases because they are faced with the testimony of the alleged victim and maybe the testimony of the alleged perpetrator with the former claiming that she did not consent to sex and the latter claiming that the alleged victim did consent to sex. How can a jury make a finding of “beyond a reasonable doubt” when there are two stories and only one of them can be right? Statistically a jury in such situations only have a 50% chance of getting it right. Nonetheless, juries are charged with determining guilt or innocence and they may not get it right, but that is the system.
