Trax Train Collides with Car in Murray
Utah Transit Authority Train Derails
After only a few weeks since a man was killed by a Trax train, another Trax related incident has occured this morning. There are few details at this point but what is known is that a trax train collided with a car in Murray, Utah derailing the train. From a personal injury attorney standpoint there may be questions of liability arising from this accident, but there are some important threshold questions to determine at the outset.
Negligence and Immunity
Although most people assume that the government is one of the best parties to sue under a personal injury claim that is not always true. While the government does normally have the funds to pay out on judgments they also have special immunities in certain situations. Based on the idea that the government is like the king historically, and the king cannot be sued, most governmental entities are protected by statutory immunity. This question of immunity is normally based heavily on statute and is not a blanket rule that the government can never be sued but it is something that needs to be considered. If the government does have immunity then that is the end of the case and there are no other issues to consider. The other threshold questions is concerning who was negligent. In the case of the Trax accident if it was the driver of the car that was negligent then obviously that driver has no claims against Trax because it was their fault.
