Huge Medical Malpractice Lawsuit in Taiwan
HIV-infected Organs Transplanted
A well regarded hospital in Taiwan mistakenly transplanted HIV-infected organs to five different patients. The patients are now being treated with anti-AIDS drugs but it is reported that the five organ receivers will very likely contract HIV and their treatment will be very difficult because they will also have to receive treatment so the new organs are not rejected by their bodies. The mistake over the infected organs was made when a hospital staffer mistakenly believed he heard that the organs were non-reactive over the phone when in fact the word reactive was used. The doctors and nurses who performed the transplants are now also concerned that they may have contracted the disease from the operation as well. Although precautions are taken against exposing yourself to bodily fluids in an operation needles or accidental cuts could still cause contamination.
Negligence and Medical Malpractice
The Health Department in Taiwan is going to investigate the mistake and they will decide on possible penalties. If an incident like this were to take place in America there would also be serious liability issues and the hospital and it’s staff would be facing serious medical malpractice charges. Malpractice claims are based on negligence and in this case it is clear the the hospital staff was negligent in not protecting their patients against HIV.
